JUDGMENT / ORDER

The petitioner the holder of a regular permit who operate service on the route Perambra-Guruvayur with stage carriage bearing Registration No. KL 11/AE 2268 has filed this writ petition challenging Ext.P2 proceedings of the respondent. The regular permit of the petitioner is valid upto 30.06.2014. According to the petitioner, the service is being operated on the basis of a settled set of timings. He complains that, as per Ext.P2 his timings have been revised without a hearing.
2. The learned Government Pleader on instructions submits that Ext.P2 is only a tentative set of timings to which the petitioner has been granted the right to submit objections. However, he has not admittedly submitted any objections so far.
3. A perusal of Ext. P2 shows that what has been fixed therein is only a tentative set of timings. The petitioner has been directed to submit his objections against the timings. However,

he has admittedly not submitted any objections. Therefore it is up to the petitioner to submit his objections, if he has any in respect of the tentative timings in Ext.P2. I am not satisfied that any interference with Ext.P2 is called for at this stage.
In view of the above, this writ petition is dismissed, without prejudice to the rights of the petitioner to submit objections to Ext.P2. If the objections are submitted within a period of 10 days of the date of production of a copy of this judgment, the same shall be considered before finalising the tentative timings proposed by Ext.P2.
