Heard Sri Yogendra Singh Bohra, learned counsel for the applicant and Sri G.P. Singh, learned A.G.A. for the State.
The present application has been filed with a prayer to allow this application and transfer the S.T. No. 1129 of 2017, under Sections 302, 201 IPC, P.S. Khatauli, District Muzaffar Nagar connected with S.T. No. 21 of 2018, under Sections 302, 201 IPC, P.S. Khatauli, District Muzaffar Nagar, arising out of Case Crime No. 713 of 2017, P.S. Khatauli, District Muzaffar Nagar pending in court of Additional District & Sessions Judge, Court No. 8, Muzaffar Nagar to any competent court of Sessions at District Meerut.
It has been argued by the learned counsel for the applicant that above mentioned S.T., which is pending in the court of Additional Session Judge, Court No. 8, Muzaffar Nagar be transferred in Merrut to any competent court because there is threat to applicant's life from opposite party no. 2. Regarding the said threat, he has stated that two applications were written by him to S.S.P., Meerut but no action was taken on behalf of the said S.S.P.
I am not inclined to accept the argument of the learned counsel for the applicant because he has remedy available to move bail cancellation of the accused from whom he is receiving threat.
In view of above, I do not seen any sufficient ground to transfer the said case from the said court. Accordingly, the transfer application is dismissed.
