1. Heard Sri Kamal Kumar Kesherwani, learned counsel for the petitioner and Sri Bhola Nath Yadav, learned counsel for the respondent nos.4, 5 and 6.
2. By means of the present petition, challenge has been raised to the order dated 31.3.2021 passed by the District Basic Education Officer, Saharanpur. By that order, post retiral dues of the petitioner's husband (since deceased) have been denied for reason of her having not opted to retire at the age of 60 years.
3. It is admitted at the Bar that this controversy has been adjudicated by a learned Single Judge of this Court in Writ A No.17399 of 2019 (Usha Rani Vs. State of U.P. & 6 Others) decided on 07.11.2019 as corrected by order dated 12.12.2019. The special appeal filed from that decision is also stated to have been dismissed.
4. In such circumstances, no useful purpose would be served in keeping the present petition pending or calling for any counter affidavit, at this stage.
5. In light of the statement made, the present petition is also allowed on the same terms and conditions as in Writ A No.17399 of 2019 (Usha Rani Vs. State of U.P. & 6 Others) decided on 07.11.2019 as corrected by order dated 12.12.2019.
