Heard Sri Dhananjay Kumar Thakur, learned counsel for the petitioner, learned Standing Counsel for the State-respondent and Sri J.N. Maurya, learned counsel for the respondent nos.2 and 3.
By means of this writ petition, the petitioner has prayed for the following relief:
A. Issue a writ, order or direction in the nature of mandamus commanding/directing the respondent nos.2 to 5 to stop the brick kiln which is running over the Arazi No.23 and 269 situated in Village Samogara, Pargana-Khairagarh, Tehsil Meja, District Allahabad within specific period as may be fixed by this Hon'ble Court.
Sri J.N. Maurya, learned counsel for the respondent nos.2 and 3 has pointed out that the petitioner's husband had earlier approached this Court by filing writ petition i.e. Writ-C No.18704 of 2017, which was disposed off by a co-ordinate Bench of this Court on 5.5.2017. Thereafter, again he filed a writ petition i.e. Writ-C No.14502 of 2019, which too was dismissed by a co-ordinate Bench of this Court on 25.4.2019. Now again the present writ petition has been filed by sister-in- law of the petitioner.
After some argument at length, learned counsel for the petitioner prays to withdraw this writ petition.
In view of the statement made above, the writ petition is dismissed as withdrawn without any further liberty.
