JUDGMENT / ORDER

Heard learned counsel for the applicant, learned A.G.A. for the State. The accused applicant Shyamji alias Suddoo Tiwari is involved and detained in Case Crime No. 453 of 2009, under Sections 2/3 of U.P. Gangster Act from Police Station Shivratanganj, District Raibareli and he has applied for bail.
The submission of the learned counsel for the accused applicant is that as per gang chart as many as three criminal cases has been shown against the accused applicant. The first criminal case has been registered as N.C.R., in second criminal case he had been convicted but has been released on bail during the pendency of appeal and in third case he is already on bail. Therefore accused applicant deserve to be released on bail in this case too.
Learned A.G.A opposed the prayer for bail.
Considered the submission of the learned counsel for the applicant and the learned Additional Government Advocate, and keeping in view the facts of the case without expressing any opinion on the merits of the case, applicant may be released on bail.
Let applicants Shyamji alias Suddoo Tiwari be released on bail in aforesaid case crime number on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court Concerned.
