Heard Sri Kamlesh Sharma, learned counsel for the petitioner, learned Standing Counsel for the State respondents and Sri Jay Prakash Gupta holding brief of Sri Sunil Kumar, learned counsel for the Gram Sabha-respondent no.4. Perused the record.
The present writ petition has been filed seeking direction to the respondent no.2-Tehsildar, Tehsil Ghazipur, Pargana Pachotar, District Ghazipur to decide the Case No.04397 of 2019, Computer Case No.T201914291004397 (Lekhpal Vs. Tuntun), under Section 67 of U.P. Revenue Code, 2006, pending in the court of learned Tehsildar, Tehsil Ghazipur Sadar, District Ghazipur.
It is contended by learned counsel for the petitioner that the petitioner has filed an application under Rule 109 of U.P. Consolidation of Holdings Act, 1953 for eviction of respondent no.4 as he is the unauthorized occupant of the said land. The said application has not yet been decided till date.
It is further contended by learned counsel for the petitioner that the general dates are fixed in the matter.
Under these circumstances, a direction is issued to the respondent no.2-Tehsildar, Tehsil Ghazipur, Pargana Pachotar, District Ghazipur to look into the matter and decide the same as expeditiously as possible preferably within a period of one year from today without granting any unnecessary adjournment to either of the parties.
The writ petition is accordingly disposed of.
