Shyamalakumari vs Perumkadavila Grama Panchayath

High Court Of Kerala|18 December, 2014
|

JUDGMENT / ORDER

The petitioner complains that the Panchayat authorities are preparing to trespass into her property and to cut open a road through the same without initiating any land acquisition proceedings.
2. Adv.Sri.R.Gopan appears for the Panchayat. According to the counsel, the petitioner has encroached upon thodu puramboke. Complaints have been made by the local residents to the District Collector. Under orders of the District Collector, some proceedings have been initiated, to measure and identify the puramboke. The petitioner has filed this writ petition in the said context. The learned Government Pleader appears for respondents 2 and 3.
2. Heard. Since Ext.P2 is pending consideration of the 3rd respondent, it is sufficient that the said authority considers the objections of the petitioner and passes appropriate orders in the matter. It is not possible for this Court to go through the disputed questions of fact within the limits of the jurisdiction under Article 226 of the Constitution.
In view of the above, this writ petition is disposed of directing the 3rd respondent to consider Ext.P2 representation submitted by the petitioner in accordance with law, with notice to the petitioner as well as respondents 1 and 2 and to pass appropriate orders thereon as W.P.(C) No.28637 of 2014 2 expeditiously as possible and at any rate within a period of two months of the date of receipt of a copy of this judgment.
