Heard Sri Sudhakar Shukla, learned counsel for the petitioner, learned Standing Counsel for the State-respondent no.1 and Sri Devi Prasad Mishra, learned counsel for the respondent nos.2 and 3.
By means of this writ petition, the petitioner has come up before this Court with the prayer to quash the impugned order dated 20.05.2019 issued by the respondent no.3 and further prayer has been made for a direction to the respondents not to interfere in the peaceful possession of House No.209H/1R/1K, Om Prakash Sabhasad Nagar, Rajrooppur, P.S. Dhoomanganj, District Prayagraj.
Against the order impugned, the petitioner has right of appeal under Section 27 (2) of U.P. Urban Planning and Development Act, 1973.
We are not inclined to interfere in the matter. The writ petition is, accordingly, dismissed on the ground of statutory alternative remedy.
It is open to the petitioner to take recourse to the statutory remedy available to her under the law. In case, the petitioner files an appeal, needless to say that the same shall be decided in accordance with law.
