Heard learned counsel for the parties.
By the instant writ petition, petitioner, a constable, is assailing the order of dismissal.
Learned Standing Counsel submits that the order is appealable under the Uttar Pradesh Police Officers of the Subordinate Ranks (Punishment and Appeal) Rules, 1991. This fact is not being disputed by learned counsel for the petitioner.
In view thereof, writ petition is disposed of as withdrawn with liberty to the petitioner to take appropriate remedy before the appropriate forum in accordance with the Rules.
In the event, the appeal is preferred, it is expected that the competent authority shall consider and decide the appeal by a reasoned and speaking order on merit.
