JUDGMENT / ORDER

By way of present application the applicant has prayed to fix the early date of hearing of Criminal Appeal No.2272 of 2009.
Heard Mr.K.I. Kazi, learned counsel for the applicant and Mr.H.L. Jani, learned Additional Public Prosecutor appearing for respondent-State.
Mr.Kazi, learned counsel for the applicant, states that the applicant is behind the bars since long and the Appeal is of the year 2009. He, therefore, prayed for early hearing of the Appeal.
Looking to the pendency of old Criminal Appeals, present application cannot be entertained. The applicant is permitted to file fresh application for fixing the date of early hearing of the Criminal Appeal if his Appeal is not heard within one year.
In view of above, present application deserves to be dismissed and is hereby dismissed.
