Heard learned counsel for the petitioner; learned Standing Counsel for the respondents and perused the record.
The present petition has been filed for a direction upon the District Magistrate, Allahabad to grant firearm license to the petitioner within a stipulated period.
It is contended by learned counsel for the petitioner that he has moved an application on 13.01.2011 before the District Magistrate, Allahabad for grant of firearm license but, till date, the same has not been decided.
It is not in dispute that in the year 2016, new Arm Rules, 2016 have been notified.
Under the circumstances, it would be appropriate that the petitioner apply for fire arms license under the new Arms Rules, 2016. It is expected that if any fresh application for grant of fire arms license is submitted by the petitioner, after completing all necessary formalities, along with certified copy of this order, the authority shall endeavour to dispose it of expeditiously, preferably, within a period of three months from the date of filing of such application in accordance with law as per Arms Rules, 2016 and the provisions of Arms Act, 1959.
With the aforesaid liberty and observation, this petition is disposed off.
It is made clear that the Court has not adjudicated the case on merits.
