Heard Sri Chandra Narayan Mishra, learned counsel for the petitioner and Sri Pawan Shukla, learned A.G.A. for the State and perused the record.
This writ petition has been filed with a prayer to quash the FIR dated 16.3.2018 registered as Case Crime No. 73 of 2018, under Sections 279 and 388 IPC, P.S. Bithoor, District Kanpur Nagar.
Learned counsel for the petitioner submitted that the petitioner along with her wife had earlier challenged the FIR of Case Crime No. 105 of 2017, under Section 406, 352 and 506 IPC, P.S., Kalyanpur, District Kanpur Nagar, in which their arrest have been stayed by the co-ordinate Bench of this Court in Crl. Misc. Writ Petition No. 6999 of 2017 (Smt. Sneh Lata Gupta and another).
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
