Petitioner was selected for appointment to the post of Constable (GD) in Central Industrial Security Force and appointment order was issued to him on 20.3.2017. It appears that at the time of verification of his character role, it transpired that a criminal case was pending against him. Such criminal case has already resulted in acquittal of the petitioner vide order dated 28.5.2017, passed by the competent court in Criminal Case No. 580 of 2015, under Sections 147, 452, 323, 504 and 506 I.P.C. P.S. Tappal, District Aligarh.
Matter with regard to grant of appointment to petitioner in view of the lodging of criminal case against him was referred to the screening committee, constituted for the purpose. The screening committee has examined petitioner's record and has opined that the petitioner is suitable for appointment in Central Industrial Security Force. This letter dated 2.7.2018 has been marked to petitioner and is, contained in Annexure -10 to the writ petition. Grievance of the petitioner is that even thereafter he has not been allowed to join.
Sri P.K. Srivastava has entered appearance on behalf of respondents. It is stated that the claim of the petitioner shall be considered in light of the recommendation of screening committee by the third respondent.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to petitioner's claim for appointment and for being sent for training, keeping in view the recommendation made by the Screening Committee on 2.7.2018, A reasoned order, shall be passed in accordance with law within a period of six weeks from the date of presentation of certified copy of this order.
