Heard learned counsel for petitioner and learned Standing counsel for State-respondent.
A complaint is stated to have been filed against the Village Pradhan, which is pending.
Grievance of the petitioner is that the authorities are not proceeding in accordance with Rule 3 of the U.P. Panchayat Raj (Removal of Pradhans, Up Pradhans and Members) Enquiry Rules, 1997.
Learned Standing Counsel states that an appropriate decision would be taken by the competent authority, in accordance with law.
In that view of the matter, this petition stands disposed of with a direction to respondent no. 2- District Magistrate, Ballia, to ensure that appropriate steps, as may be warranted in accordance with Enquiry Rules, 1997 read with Section 95(1)(g) of the U.P. Panchayat Raj Act, are taken against the Pradhan concerned, expeditiously, preferably within a period of six months, after affording an opportunity of hearing to Pradhan concerned.
The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
