Vakalatnama filed by Ms. Anadi Krishna Narayana, learned Advocate on behalf of respondent nos. 2 and 3.
The allegations in the suspension order are of issuance of forged gate-pass which had resulted in large scale misappropriation of money.
The suspension order preceded by a preliminary enquiry. The grounds to assail the suspension order are that the petitioner has been made scapegoat by the superior officers and the gate passes were issued by him under the instructions of the then Secretary of the Mandi Samiti. This explanation can be offered by the petitioner during the course of regular departmental enquiry.
The suspension order cannot be interfered on this ground.
At this stage learned counsel for the respondent submits that all efforts are being made to initiate the departmental enquiry at the earliest and the respondent will take care to conclude the same.
In view of the said statement, without entering into the merits of the suspension order, it is provided that the respondent shall take all steps to conclude the departmental enquiry, preferably, within a period of three months from the date of submission of certified copy of this order. The petitioner shall be under obligation to co-operate in the enquiry at each and every stage.
Subject to the above observations and directions the writ petition is disposed of.
