Heard learned counsel for the applicant, Sri Baleshwar Chaturvedi, learned counsel for the respondent no. 2 and learned A.G.A. for the State.
This application under Section 482, Cr.P.C. has been filed for quashing the non-bailable warrants dated 23.05.2018 passed in Case Crime No. 126 of 2013, under Section 136 Electricity Act, PS-Hasayan, District-Hathras by the Additional District Judge, Court No. 1, Hathras.
After having heard the learned counsel for the applicant and perused the material brought on record, I do not find any justification for quashing the impugned order in the aforesaid case. The prayer for quashing the same is hereby refused.
However, for a period of 15 days from today, the non-bailable warrants issued against the applicant shall be kept in abeyance. In the meanwhile, applicant may surrender before the Court below and apply for bail.
In case, the applicant does not appear before the court below within the aforesaid period, coercive action shall be taken against him.
It is made clear that the applicant will not be granted any further time by this Court for surrendering before the Court below as directed above.
With the aforesaid directions, this application is finally disposed of.
