Heard learned counsel for the parties.
The petitioner has filed this petition seeking a direction upon the Central Administrative Tribunal, Allahabad to decide Original Application dated 15.10.2016 within a fixed period of time particularly on the next date i.e.30.04.2019.
It is not possible to issue any direction for deciding the above application on 30.04.2019 i.e. today itself.
As far as the contention that sometime time bound period be fixed for deciding the same, we are of the opinion that as the petitioner is not alleging that the aforesaid application is being unnecessarily delayed due to adjournments by the other side or on account of avoidance by the Tribunal to decide the same. Thus, we do not deem it necessary to issue any time bound direction in this regard.
It is always open for the petitioner to move to the Tribunal with the request of early disposal. In fact, we find from the record that the petitioner had earlier moved an application for expeditious disposal and on the said application, the Tribunal had previously fixed 25.07.2018 as the next date for final hearing meaning thereby that the Tribunal is conscious and is taking steps for the expeditious disposal of the matter.
In view of above, we do not consider it appropriate to exercise any discretion in favour of the petitioner.
The writ petition is accordingly dismissed.
