Heard Sri H.R. Misra, the learned Senior Counsel assisted by Sri Abhishek Misra, learned counsel for the petitioners and the learned standing counsel.
Learned counsel for the petitioners is permitted to implead the Commissioner concerned as respondent no.3. He is further permitted to make necessary corrections in the prayer clause as regards the number of revision.
It is urged that appropriate direction be issued to respondent no.3 to either decide the stay application or to decide the Revision No.C201705001663 of 2017 itself, within a stipulated period.
Learned standing counsel submits that no useful purpose would be served by keeping this petition pending, it be disposed of by giving appropriate direction to the respondent concerned.
Considering the facts and circumstances of the case, this petition is disposed of with the direction to the respondent concerned to either decide the stay application preferably on the next date fixed or to decide the pending revision, as expeditiously as possible, preferably within 3 months from the date of the production of the certified copy of the order. It is made clear that the respondent concerned would not grant unnecessary adjournments, adjournments if any, shall be for strong and compelling reasons, else would attract cost of Rs.250/-, to be paid to the other side.
Learned counsel for the petitioners undertakes not to seek any frivolous adjournment before the respondent concerned.
It is clarified that the proceedings as far as possible should not be repeatedly adjourned, merely on the ground that the Presiding Officer is busy in administrative work.
Service of the certified copy of the order upon the respondent concerned shall constitute sufficient notice to submit a compliance report.
List on 12.7.2018 in Chambers at 4.00 PM along with a compliance report.
