Heard learned counsel for the applicant and learned A.G.A. for the State.
The instant anticipatory bail application has been filed with a prayer to grant anticipatory bail to the applicant, Shyam Pratap Yadav, in Case Crime No. 873 of 2020, under Sections- 419,420,406 I.P.C., Police Station- Compierganj District- Gorakhpur.
There is allegation in the First Information Report that plot no.294 M was sold to the wife of the informant when plot no. 293M was shown to the informant and his wife which was being sold.Learned counsel for the applicant has referred the sale deed which shows that plot no. 294M it was regarding plot No. 294M executed and not plot no.293M. Learned counsel for the applicant has submitted that recital in the sale deed is final.The informant and his wife are literate person and they signed the documents after seeing the same.
The applicant was already on interim anticipatory bail by order dated 04.02.2021of this court.
The order is confirmed.
Applicant will remain on anticipatory bail till cognizance is taken by the court on the police report u/s 173 (2) Cr.P.C. on same terms and conditions as mentioned in the order dated 04.02.2021.
The anticipatory bail application is allowed to the aforementioned extent.
