Heard learned counsel for the petitioner.
The petitioner claims to be a fair price shop card holder, grievance of the petitioner is that the fair price shop was allotted to Smt. Kanti Devi who since died, consequently, the distribution of the fair price shop has been attached with Kehar Singh of Latifpur, a neighbouring village.
It is urged that the villagers are facing hardship and no decision to initiate proceeding for fresh allotment of fair price shop has been taken by the third respondent, Sub-Divisional Magistrate, Tehsil Gunnaur, District Sambhal.
The petitioner by the instant writ petition seeks the following reliefs:
"(A) Issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to decide the application of the petitioner within stipulated period.
(B) Issue a writ, order or direction in the nature of mandamus directing the Gaon Sabha Latifpur Dheer, Block Junawal, Tehsil-Gunnaur, District Sambhal to hold general meeting regarding allotment of license of fair price shop in the aforesaid village."
Learned counsels appearing for the State and fourth respondent submits that grievance of the petitioner and the villagers shall be considered and redressed expeditiously.
In view thereof, the writ petition is disposed of directing the third respondent, Sub-Divisional Magistrate, Tehsil Gunnaur, District Sambhal, to take a decision in the matter, in accordance with law, by a reasoned and speaking order, expeditiously preferably within eight weeks from the date of receipt of certified copy of this order along with the copy of the writ petition before the third respondent.
