Heard counsel for the petitioners, learned standing counsel and Sri Manoj Kumar Yadav appearing for respondent no. 4.
This writ petition has been filed challenging the order dated 12.7.2018 passed by the Deputy Director of Consolidation, whereby stay application moved by the petitioners in their pending Revision No. 1119, has been rejected.
Submission of the learned counsel for petitioners is that as per order dated 21.4.1969, name of the petitioner was directed to be recorded over the land bearing plot no. 182. Subsequently, the appeal filed by the State of U.P. against the said order dated 21.4.1969, has been allowed by the Settlement Officer Consolidation vide order dated 29.6.2018. Being aggrieved by the said order, the petitioners preferred a revision alongwith an application for interim order before the Deputy Director of Consolidation, who by the impugned order dated 12.7.2018 admitted the revision but rejected the stay application.
The record reflects that in Public Interest Litigation No. 3098 of 2018, this Court is monitoring the entries in respect of plot no. 182 which was earlier recorded as a pond, and as per direction issued by this Court in the aforesaid PIL, the pond was directed to be restored to its original form.
In view of the above admitted position, this Court finds no illegality or infirmity in the impugned order rejecting the stay application, which otherwise also is an interlocutory order, hence no case for interference under Art. 226 of the Constitution is made out.
The writ petition lacks merit and is accordingly dismissed. No order as to costs.
