Shyam Narayan Mishra vs Chairman

High Court Of Judicature at Allahabad|20 December, 2019
|

JUDGMENT / ORDER

Court No. - 39
Case :- WRIT - A No. - 21117 of 2019 Petitioner :- Shyam Narayan Mishra Respondent :- Chairman, U.P. Power Corporation Limited, Lucknow And 5 Others Counsel for Petitioner :- Niraj Tiwari,Rohit Tiwari Counsel for Respondent :- Abhishek Srivastava,Kapil Dev Singh Rathore
Hon'ble Ashwani Kumar Mishra,J.
Petitioner states that he is entitled to annual increment between the period 01.07.2013 to 30.06.2014, and that his claim has not been considered in that regard.
The petition is opposed by learned counsel for the respondents by submitting that petitioner's claim is highly belated.
Admittedly, petitioner has retired on 30th June 2013. No claim was raised for grant of such benefit within a reasonable period. The judgment of the Madras High Court in the case of P.Ayyamperumal Vs. The Registrar, Central Administrative Tribunal, Madras Bench, High Court Complex, Chennai and others (Writ Petition No. 15732 of 2017), is made the basis for petitioner's claim which was delivered on 15.09.2017. This judgment would not constitute any basis for the petitioner to seek revision of salary almost after three years. A fresh representation is not required to be entertained for reopening of such issues, after long lapse of time. No direction, therefore, is required to be issued, as is prayed for, in this petition.
The writ petition is, accordingly, dismissed.
