Present application has been filed for quashing the order dated 01.6.1999 passed by the Judicial Magistrate-I Jhansi in F.R. Case No. 31 of 1998 arising out of case crime No. 130 of 1997 under Sections 364, 302, 201 IPC, police station Kotwali Jhansi, district Jhansi, whereby the final report submitted by the police has been rejected and order for final investigation has been passed.
After hearing the learned counsel for the opposite party No.2, learned A.G.A. and after perusing the averments contained in the present 482 application as well as the material on record, this Court is of the opinion that no good ground is made out which may warrant interference by this Court in exercise of power conferred under Section 482 Cr.P.C. for quashing the order impugned.
Accordingly, the prayer for quashing the order impugned is refused. The present application lacks merit and is dismissed.
Interim order, if any, stands discharged.
Sri Harsh Narayan Singh learned counsel for the private opposite party undertakes to inform the leaned counsel for the applicants in writing 48 hours about the order passed today.
