JUDGMENT / ORDER

Petitioner is the second accused in Crime No.716 of 2013 of the Bekal Police Station for the offences punishable under Sections 341, 302, 212 r/w Section 34 of the Indian Penal Code, is in custody from 25.09.2013 and seeks bail.
2. Learned Public Prosecutor has opposed the application.
3. I have heard the learned counsel for the petitioner also.
4. In the previous applications- B.A.Nos.646 of 2014 and 2109 of 2014, I have referred to the facts and circumstances of the case and found that request of the petitioner for bail cannot be allowed. I also directed that the committal/trial of the case has to be expedited. Necessary direction was issued in that regard and copy of the order were sent to the Courts concerned. In the light of that, it not necessary to re-state all the facts and circumstances in this order.
5. Having heard the learned Public Prosecutor and the learned counsel for the petitioner, I do not find any change of circumstances to take a different view from the view already taken regarding request of the petitioner for bail.
6. Learned Public Prosecutor submits that the case is committed to the Sessions Court for trial. That Court has to dispose of the case as early as possible.
7. Learned counsel submits that marriage of sister of the petitioner is schedule to be held on 29.05.2014. Arrangement could be made to take the petitioner, if he so wishes to attend that function.
Application is disposed of as under:
(i) Request of the petitioner for bail is rejected.
(ii) Learned Sessions Judge, Kasaragod who is to try the case is directed to dispose of the case as early as possible.
(iii) In case the petitioner so desires, he shall be taken to the place of marriage of his sister on 29.05.2014 with necessary Police Escort from 10.00 a.m to 03.00 p.m.
(iv) The Sub Inspector of Police, Bekal shall make necessary arrangements to provide Police escort for the aforesaid purpose without any further orders.
(v) After 03.00 p.m., the petitioner shall be brought back to the jail where he is detained.
Registry shall send a copy of this order to the Principal Sessions Judge, Kasaragod.
Petitioner shall give a copy of this order to the Superintendent of the jail where the petitioner is detained and the Sub Inspector of Police, Bekal for compliance.
