1. Heard learned counsel for the applicants, Shri Brijesh Kumar, learned counsel for the informant and learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicants - Shyam Mohan, Kamla Saroj, Neelam Saroj, Anju Devi and Mantu Saroj, seeking anticipatory bail in Case Crime No. 0083 of 2021, under Sections -3/4 of D.P. Act, Police Station - Meja, District - Prayagraj, during pendency of trial.
3. Learned counsel for the applicants submits that a simple matrimonial discord has been blown out of proportion. Referring to the injury report it is stated that all injuries are simple in nature. Then, it has been submitted that all the family members of the applicant no.1 have been falsely implicated only because of deep harassment.
4. The bail application has been vehemently opposed by the learned AGA and learned counsel for the informant.
5. Learned counsel for the informant submits that there is an earlier criminal complaint of similar nature, wherein upon undertaking given by the applicants the victim had rejoined her matrimonial relationship. Then, referring to the FIR allegations it has been submitted that all applicants were involved in the commission of offence.
6. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicants to apply for regular bail, which application when filed may be considered on its own merit without being prejudiced by any observation made in this order.
