Heard Sri Sharve Singh, learned counsel for the appellant and Sri Vipul Kumar, learned counsel for the insurance company.
The appeal was taken up on 17.12.2018 and this Court passed the following order:
"During the course of the argument, Ms. Neerja Singh, holding brief of Sri Sharve Singh, learned counsel for the appellant submits that the claimant appellant will be satisfied if they are paid Rs.50,000/- in lump sum in addition to the amount which has already been paid to him under the award in full and final satisfaction of his claim.
The offer of the claimant appellant appears to be reasonable.
Learned counsel for the Insurance Company prays for and is allowed two days time to seek instructions from the Company.
As prayed, put up on 20.12.2018."
Sri Vipul Kumar, learned counsel for the insurance company states that his client is ready to accept the offer of the appellant and is, accordingly ready to pay Rs.50,000/- as lump sum in addition to the amount which has already been paid to the appellant under the award in full and final satisfaction of the claim.
In view of the fact that the parties have entered into compromise and the insurance company is ready to pay Rs.50,000/- to the appellant towards lump sum in addition to the amount which has already been paid under the award in full and final satisfaction of the claim. The appeal is disposed of in terms of compromise.
The insurance company is directed to deposit the amount of Rs.50,000/- within a period of two months from today. In case, the same is not deposited within the aforesaid period, the amount shall carry interest @ 7%.
