JUDGMENT / ORDER

Petitioner is the 5th accused in Crime No.1152 of 2013 of the Hosdurg Police Station for the offences punishable under Sections 143, 147, 148, 341, 324, 326, 308 r/w Section 149 of the Indian Penal Code, apprehends arrest and has filed the application.
2. Learned Public Prosecutor has opposed the application. It is submitted that on 19.09.2014 at about 04.30 p.m., the petitioner and others formed unlawful assembly and attacked the de facto complainant and another with iron pipe, shock absorber etc. Two persons sustained injuries. One of them suffered fracture. Petitioner is involved in three other cases and is being proceeded against under Section 107 of the Cr.P.C.
3. Learned counsel requested for relief and contended that the allegations are not true.
4. Having regard to the nature of allegations made against the petitioner, investigation required to be done and considering his antecedents request for pre-arrest bail cannot B.A.No.3017 of 2014 2 be allowed.
It is directed that in case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
Application is dismissed.
