JUDGMENT / ORDER

Heard Counsel for the petitioner and the Standing Counsel on behalf of the respondents.
Counsel for the petitioner states that the petitioner was appointed on Class IV post in the year 1989 and since then he is stagnating on the same post. According to Rules the persons who have completed five years service on a Class IV post and possess Intermediate certificate, they are entitled for promotion. The petitioner is fully eligible for promotion in view of the G.O. Dated 3.9.1995 but till date inspite of lapse of considerable long time, he has not been promoted on Class-III post.
Standing Counsel states that at present there is no class III post vacant in the department and as such the petitioner has not been promoted. As soon as the vacancy occurs, the petitioner will be considered for promotion.
In view of the above, this writ petition is disposed of with the direction to the opposite parties to consider the promotion of the petitioner on Class III post as soon as the vacancy in Class III occurs.
