Heard Sri Grijesh Tiwari, learned counsel for the petitioner and the learned Standing Counsel for the respondents.
The petitioner in the writ petition is seeking quashing of the order dated 6 July 2018 whereby the petitioner, who is working as Block Education Officer, Aligarh, has been transferred on administrative grounds to District Mathura.
The contention of the petitioner is that his wife, who is suffering from some disability, was transferred from Sambhal to Aligarh in July 2018 and has joined at Aligarh in the Primary School, Sadal Block-Lodha and, therefore, his claim for being retained at Aligarh may be considered in view of the Government Transfer Policy dated 29 March 2018.
No useful purpose would be served by keeping the matter pending.
The writ petition is, accordingly, disposed of with a direction that if the petitioner represents to the Director of Basic (Education), U.P. at Lucknow within one week from today along with a certified copy of this order, the Director shall consider and decide the claim of the petitioner within fifteen days thereafter.
It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
