Heard learned counsel for petitioners as well as learned AGA for the State.
This writ petition has been filed challenging FIR dated 20.04.2021 registered at FIR/Case Crime No.122 of 2021, under Sections 147, 148, 149, 395, 397, 332, 353, 504, 506, 427, 336, 307, 34 IPC and Section 7 Criminal Law Amendment Act and Section 131, 132 (3), 135A Representation of People Act, at Police Station Kandhai, District Pratapgarh.
After arguing the matter at some length, learned counsel for the petitioners states that he may be permitted to withdraw this writ petition with liberty to the petitioners to take recourse to the remedy available under Section 438 Cr.P.C.
Accordingly, the writ petition is disposed of with aforesaid liberty.
However, it is directed that in case the petitioners approach the court of competent jurisdiction by way of moving appropriate application under Section 438 Cr.P.C., the same shall be considered and decided in accordance with law, with expedition.
