Shyam Krishna vs Abhay Singh

High Court Of Judicature at Allahabad|01 September, 2014

JUDGMENT / ORDER

Heard Shri Shashi Kant Upadhyay, learned counsel for applicant.
The present contempt application has been filed for punishing the opposite party for alleged wilful disobedience of order dated 07.03.2014 in Writ- C No.14306 of 2014.
By order dated 07.03.2014, this court disposed of the writ petition with the direction to opposite party to decide application nos. 837, 838 and 839 dated 18.12.2010 under Section 34 of U.P. Land Revenue Act, pending before it expeditiously, keeping in mind the urgency of matter and pendency of cases of such nature of previous years.
The court has perused the order sheet of said case and finds that either the Presiding Officer who also happens to be an Administrative Officer is busy in administrative work which if not less is equally important or the lawyers are on strike. In this view of the matter, mere fact that applications could not be decided does not ipso facto, amount to wilful disobedience.
No contempt is made out.
Contempt application is dismissed. However, opposite party would continue its sincere endeavour to dispose of the applications, in the light of order dated 07.03.2014, so as to ensure its compliance in letter and spirit.
