Heard learned counsel for the applicant and learned A.G.A.
This application has been filed with prayer to quash the chargesheet in case crime No. 395 of 1998 under sections 193, 196, 420, 465, 466, 67, 471, 468, 477-A, 201, 120-B IPC and section 13(1)(d) read with 13(2) P.C. Act, P.S. Kaisharbagh, District Lucknow. pending in the court learned Special Judge, (Prevention of Corruption Act), Lucknow vide criminal case No. Crl. case No. 53 of 2007.
From the perusal of the record, it appears that on the basis of material collected by the I.O. the prima facie offence is made out. Therefore, there is no irregularities or illegality in filing the charge-sheet, the prayer for quashing the charge-sheet is refused.
However, considering the facts and circumstances of the case, it is directed that in case the applicant appears before the court concerned within 30 days from today and applies for bail, the same shall be heard and disposed of expeditiously if possible on the same day by the courts below. After appearance on bail, in case the applicant raised the plea of submission of chargesheet, the same shall also be heard and disposed of in accordance with law.
With this direction, this application is finally disposed of.
