JUDGMENT / ORDER

Heard Ms. Savita Jain, learned counsel for the petitioner.
Notices for the opposite parties have been accepted by Sri Rishabh Kapoor, learned counsel, who has put in appearance on their behalf.
By means of this petition, the petitioner has prayed that the opposite parties be directed to release the amount of gratuity, leave encashment and Group Insurance along with permissible interest on the delayed payment.
The petitioner has retired from service on 31.12.2018 and as per learned counsel for the petitioner, he has completed all necessary formalities for getting his post retiral dues but till date, the aforesaid retiral dues have not been paid to the petitioner.
Sri Rishabh Kapoor, learned counsel for the opposite parties has submitted that the Jal Nigam is not disputing to make payment of retiral dues but due to some financial crunch and constraints payments of the petitioner and so many employees of the Jal Nigam could not be made well in time, however, the State Government is now considering the plight of the Jal Nigam and necessary exercises have been proposed to sanction the amount to the Jal Nigam so that the payment of post retiral dues and dues of the employees of the Jal Nigam could be made with expedition.
Since this is undisputed fact that the retiral dues of the petitioner have not been paid for which the petitioner is legally entitled, therefore, the opposite parties are directed to make payment of post retiral dues/ dues of the petitioner with promptness, preferably within a period of four months from the date of production of certified copy of this order. The petitioner may also prefer a representation to the competent authority for claiming interest on the delayed payment of the post retiral dues strictly as per law and if the law permits for the same, the petitioner shall also be paid interest on the delayed payment of post retiral benefits.
In the aforesaid terms, the writ petition is disposed of finally.
