1. Sri Om Prakash Tripathi, Advocate for appellants and Sri Arun Kumar Shukla, Advocate for respondents are present and have submitted an application requesting for disposal of appeal in terms of settlement arrived at between them. The contents of application read as under:-
"1- That the parties are ready and willing to compromise the above FAFO.
2- That the parties have agreed upon settlement of this Appeal/FAFO on the following terms and conditions:-
i) In view of the fact that FAFO No. 1246 of 2006 filed by the Oriental Insurance Company Ltd. Challenging the judgment and award 06.02.2006 passed in MACP No. 368/2004 has been compromised, hence, present appeal has become infructuous. Under the circumstances present FAFO may be dismissed as infructuous.
3- That the parties have compromised the appeal out of their free consent and without any coercion/pressure of any kind.
That it is most respectfully prayed that the above Appeal/FAFO be dismissed/decided on the terms stated above."
2. In view of above, appeal stands disposed of in terms of the aforesaid compromise.
