Heard learned counsel for the applicants, Sri Vikas Sahai, the learned A.G.A. for the State and perused the record.
The present application for grant of anticipatory bail has been filed by the applicant in case crime No.184 of 2019, under Sections 147, 148, 308, 324, 336, 323 I.P.C., Police Saidpur, District- Ghazipur.
On the last occasion, learned counsel was directed to file a further affidavit explaining the special circumstances in light of the decision rendered in Vinod Kumar Vs. State of U.P. and Another (Criminal Misc. Bail Application No.53729 of 2019). Although a supplementary affidavit is tendered today, the Court notes that all that is asserted in that affidavit is that Section 438 Cr.P.C. provides a constitutional guarantee of personal liberty. In the absence of any circumstances having been alluded to, the Court finds itself unable to entertain this application which shall stand consequently rejected.
This order however shall not preclude the applicants from petitioning the Sessions Court for grant of anticipatory bail.
