Heard learned counsel for the petitioner and Shri Rajesh Kumar, learned Standing Counsel.
The petitioner is before this Court for a direction to third respondent to get demarcation done over plot no.38 area 1.726 hect. situated at Village Kanjauli Pargana Sumerpur, Tehsil and Distt. Hamirpur within stipulated period. It is contended that regarding his grievance he has also moved application on 31.12.2018 to the second respondent and the same may be directed to be decided expeditiously.
Learned Standing Counsel raised an objection that the relief as has been framed and drawn cannot be accorded to the petitioner. For redressal of the grievance there is full fledged mechanism. In case the petitioner moves any application under Section 24 of U.P. Revenue Code, 2006 read with Rule 22 of U.P. Revenue Code Rules, 2016 for redressal of his grievance, then definitely the authority would proceed to decide the said application.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of with observation that in case any such application as per the aforesaid provisions is moved within ten days, the Sub Divisional Magistrate concerned may decide the same in accordance with law within 90 days thereafter but certainly after giving opportunity to all the stake holders in the matter.
