Heard learned counsels for the parties.
The instant petition is directed against the order dated 24.02.2020 passed by fifth respondent, Executive Engineer, Tube-well Division, Hamirpur withholding the gratuity of the petitioner to the tune of Rs. 104006/- in anticipation of final decision of this Court in Writ Petition No. 56317 of 2016 (Shyam Charan Sahu Vs. State of U.P. and others), which has already been allowed vide order of date in favour of the petitioner.
In view thereof, request is made by learned counsel for the parties that this petition may also be decided in the light of judgment of date in Writ Petition No. 56317 of 2016 (supra).
Accordingly, the petition is allowed. The impugned order dated 24.02.2020 is set aside. The respondents are directed to release the withheld amount of gratuity in favour of the petitioner forthwith with interest at the rate of 6 % per annum from the date of retirement till actual payment is made.
