JUDGMENT / ORDER

Hon'ble Manish Mathur,J.
The case is taken up through Video Conferencing.
Heard learned counsel for petitioner as well as learned AGA for the State.
This writ petition has been filed challenging FIR dated 17.04.2021 registered at FIR/Case Crime No.0111 of 2021, under Sections 419, 420, 467, 468, 471, 272 IPC and Section 60, 64 (A) of U.P. Excise Act, at Police Station Safipur, District Unnao.
After arguing the matter at some length, learned counsel for the petitioner states that he may be permitted to withdraw this writ petition with liberty to the petitioner to take recourse to the remedy available under Section 438 Cr.P.C.
Accordingly, the writ petition is disposed of with aforesaid liberty.
However, it is directed that in case the petitioner approaches the court of competent jurisdiction by way of moving appropriate application under Section 438 Cr.P.C., the same shall be considered and decided in accordance with law, with expedition.
