1. Petitioner is challenging his non promotion to the post of Assistant Engineer. Learned counsel for petitioner could not dispute that in this regard, petitioner has a statutory alternative remedy by filing Claim Petition before U.P. Public Services Tribunal under Section 4 of U.P. Public Services (Tribunal) Act, 1976 (hereinafter referred to as “Act, 1976”). He also could not advance any substantive argument so as to persuade us not to relegate the petitioner to avail the aforesaid statutory alternative remedy.
2. The writ petition is, therefore, dismissed on the ground of alternative remedy.
