Heard learned counsel for the applicant and learned AGA for the State.
The present 482 Cr.P.C. application has been filed to quash the entire proceeding of S.T. No.29 of 2012 arising out of Case Crime No.102 of 2005, under Sections 409, 201, 120-B I.P.C and 13/1/2 of Prevention of Corruption Act, Police Station Reoti, District Ballia as well as Charge sheet no.4-B of 2011 dated 11.12.2011 and consequential order of N.B.W. pending before Special Judge (P.C. Act), Varanasi.
Learned counsel for the applicant submits that he has been falsely implicated by the police under the alleged sections.
In that view of the matter, he is permitted to move discharge application through counsel before the trial Court within a period of two weeks and the trial court shall decide the same within a period of one month from the date of production of a certified copy of this order along with discharge application.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid directions, application stands disposed of.
