In view of COVID-19 pandemic situation, the matter is being heard through Video Conferencing.
Applicant- Shyam Bahal Singh @ Durgesh Singh @ Master seeks bail in Case Crime No. 0024 of 2018 (S.T. No. 86 of 2018), under Sections 302, 201 I.P.C., Police Station- Gaura Chauraha, District- Balrampur.
This is the second bail application on behalf of the applicant. The first bail was rejected by this Court vide order dated 8.4.2019 on merits.
On the perusal of the record, it transpires that seven witnesses have already been examined by the trial court.
Having heard learned counsel for the applicant as well as learned A.G.A. for the State and considering the overall facts and circumstances of the case, the manner and gravity of offence, I do not find any fresh ground to consider the prayer for bail of the applicant. The prayer for bail is declined.
Hence, the second bail application is, hereby, rejected without expressing any opinion on the merits of the case.
However, the trial court is directed to expedite the trial of aforesaid case and conclude the same in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of six months from the date of production of a certified copy of this order, if there is no legal impediment.
