Heard learned counsel for the parties and perused the record. By means of present writ petition, the petitioner is seeking a writ in the nature of mandamus commanding the opposite parties to allow the petitioner to continue as Junior Engineer at Drainage Division, Gorakhpur and to make payment of salary in compliance of order of reinstatement of the petitioner dated 26.04.2010 passed by the Engineer-in-Chief, Irrigation, U.P., Lucknow. The submission of learned counsel for the petitioner is that the petitioner was working as Junior Engineer at Drainage Division, Gorakhpur and was placed under suspension vide order dated 30.03.2010 by the opposite party no.2. Subsequently, the said suspension order was revoked by means of order dated 26.04.2010.
The grievance of the petitioner is that though the suspension order has been revoked long back but neither any order of posting has been passed nor regular salary is being paid to the petitioner till date. The petitioner in order to ventilate his grievance submitted representation on 01.06.2010 before the Engineer-in-Chief, Irrigation, U.P, Lucknow .
Learned counsel for the petitioner prays that interest of justice would be served if necessary direction is issued to the authority concerned to consider and decide the representation of the petitioner dated 01.06.2010 by means of a speaking and reasoned order expeditiously.
Learned Standing Counsel has no objection to the prayer made by the learned counsel for the petitioner.
In view of the above, without entering into the merits of the case, the writ petition is finally disposed of with the direction to Engineer-in-Chief, Irrigation, U.P., Lucknow to consider and decide the representation of the petitioner dated 01.06.2010, contained in Annexure-4 to the writ petition, as per law within a period of 15 days from the date of production of a certified copy of this order.
