Heard Sri Pramod Kumar Singh, learned counsel for the petitioner, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 30.3.2018 registered as case crime no. 601 of 2018 under sections 467, 468, 419, 420, 409 I.P.C., police station Manjhanpur, District Kaushambi.
Learned counsel for the petitioner submits that the petitioner was terminated from his service which was challenged before this Court and he was reinstated and cost of Rs.50,000/- was imposed upon Executive Officer, Ankita Patel by learned Single Judge of this Court in Writ-A No.7838 of 2018. It is further submitted that the order of reinstatement was further challenged and was dismissed as withdrawn by Nagar Panchayat, Manjhanpur.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
