Heard learned counsel for the applicant, learned A.G.A for the State and perused the entire record.
The present bail application has been filed by the applicant in Case Crime No.20 of 2019, under Sections 489-B, 489-C I.P.C.
P.S Mugalsarai, District Chandauli with the prayer to enlarge the applicant on bail.
The contention as raised at the bar by the learned counsel for the applicant is that the applicant has been falsely implicated in the present case; that the recovery of fake counterfeit currency notes shown against the applicant by the police is false; that there is no independent or public witness of the alleged recovery; and that in case the applicant is released on bail, he will not misuse the liberty of bail and will cooperate in the trial and that he is languishing in jail since 12.01.2019 having no criminal history.
Learned A.G.A. has opposed the prayer for bail and argued that total fake currency of Rs. 5,20,000/- (260 notes of Rs.2000/-) have been recovered from the possession of the applicant and that the allegation against the applicant is serious in nature, hence the applicant is not entitled for bail.
As per prosecution version, counterfeit currency of Rs. 5,20,000 was recovered from the applicant.Having heard learned counsel for both the parties and gone through the materials placed on record and without commenting on merit of the case, the Court is of the view that the applicant is not entitled to be released on bail.
Accordingly this application is rejected.
However, the trial court is directed to expedite the trial within a period of nine months.
