(ORAL) This writ petition has been filed by the petitioner praying for issuance of mandamus to be issued to the respondents to execute fair price shop licence agreement with the petitioner as she was selected in the open general meeting of the Gram Sabha on 26.02.2018.
It has been submitted by the learned counsel for the petitioner that in pursuance of the order issued by the Block Development Officer, an open general meeting of the Gaon Sabha was held on 26.02.2018 and she secured maximum votes and a report regarding the same was submitted by the Block Development Officer, Kadar Chauk, district Budaun to the Sub Divisional Magistrate, Budaun on 27.02.2018. Yet, no decision has been taken in the matter till date. The petitioner has made a representation on 28.02.2018, the same is pending.
Accordingly, this writ petition is disposed of with a direction to the Sub Divisional Magistrate to place the recommendation made by the Gaon Sabha before the Tehsil Level Selection Committee along with report, if any, submitted by the Block Development Officer and the A.D.O. (Panchayat) and a decision shall be taken by the Tehsil Level Selection Committee within a period of three weeks from the date a certified copy of this order is produced before him.
