Heard Mr. I.M. Pandey, learned counsel for the petitioner and Ms. Suniti Sachan, learned counsel for the respondent nos. 1 to 4.
In pursuance to the order dated 17.5.2019 passed in writ petition no. 12042 (M/B) of 2019 : M/s Shukla Goods Carrier Vs. Union of India and others, the representation preferred by the petitioner with respect to reducing the penal demurrage charges has been considered and the same has been rejected vide order dated 2.7.2019 passed by the Senior Divisional Railway Manager, Northern Railway, Hazratganj, Lucknow (respondent no.2), which is impugned in the instant writ petition.
As per agreement, there is an arbitration clause for the dispute arisen between the parties. Therefore, the petitioner is having equally efficacious alternative remedy to invoke the arbitration clause.
In view of the above, the writ petition is dismissed with liberty to invoke the arbitration clause.
