JUDGMENT / ORDER

Heard learned advocates for the parties.
Having regard to the averments made in the application and the oral submissions and considering the fact that the averments made in the application are not controverted by filing reply, the applicant has shown sufficient cause for condoning delay in filing the leave to appeal application. Hence delay is required to be condoned.
In the result, the application is allowed. Delay of 39 days caused in filing the application for leave to appeal is condoned. Rule made absolute.
