JUDGMENT / ORDER

Court No. - 34
Case :- CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 10681 of 2021 Applicant :- Shubham And Another Opposite Party :- State Of U.P. And 2 Others Counsel for Applicant :- Kunwar Abhishek Singh,Suresh Pratap Singh Counsel for Opposite Party :- G.A.
Hon'ble Yashwant Varma,J.
Heard learned counsel for the applicants, Sri Vikas Sahai, the learned A.G.A. for the State and perused the record.
The instant application has been moved seeking anticipatory bail in light of the apprehension of the arrest of the applicants in Case Crime No.147 of 2021, under Sections 171-F, 323, 332, 353, 504, 506, 122 IPC, Police Station- Noorpur, District- Bijnor.
The Court finds no ground to accord the facility of anticipatory bail to the applicants who are admittedly the sons of a candidate who had participated in the Panchayat elections. Serious allegation are levelled that both were seeking to pressurize and intimidate the voters outside the polling booth. It is further alleged that when the police authorities including the informant asked them to desist from doing so, they were attacked. Their conduct of seeking to sully and disrupt an election process clearly disentitles them from being accorded the facility of anticipatory bail.
The petition fails and stands rejected accordingly.
