Heard learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record.
The instant bail application has been filed on behalf of the applicant, Shubham Rajpoot @ Anna, with a prayer to release him on bail in Case Crime No.241 of 2019, under Sections 504, 506, 354-Kha, 354 Gha, 427 IPC, Police Station Kalyanpur, District- Kanpur Nagar, during pendency of trial.
Submission is that from the statement of victim under Section 164 Cr.P.C., it appears that applicant had affair with her and thereafter, break-up has taken place between them, but he is harassing her to continue with relationship. She has also stated in her statement that she does not wants to contest the case and wants to settle their dispute.
The applicant is directed to be enlarged on bail for a period of six months. After releasing on bail, applicant shall deposit a sum of Rs.10,000/- within four weeks from today with the Mediation Centre of out which 50% shall be paid to the informant for appearance before the Mediation Centre.
The matter is remitted to the Mediation Centre with the direction that same may be decided after giving notices to both the parties.
It is directed that Mediation Centre shall decide the matter expeditiously preferably within a period of six months. Thereafter the case shall be listed before the appropriate Bench on 30.3.2020.
The Medication Centre shall intimate about the fate of medication before this Court.
After depositing the amount, aforesaid, notice shall be issued to the parties and in the case the aforesaid amount is not deposited within the aforesaid period, the interim bail granted to the applicant shall automatically be vacated.
