Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 21.10.2019 registered as Case Crime No. 189 of 2019 at P.S. Adalhat, District- Mirzapur, under Sections 406, 188, 120-B I.P.C. and 3/5A/8 U.P. Cow Slaughter Act.
The allegations in the impugned first information report are to the effect that cows entrusted with the petitioner were sold to cow smugglers for slaughter in West Bengal.
The contention of the learned counsel for the petitioner is that the allegations are false.
Be that as it may, as the allegations disclose commission of cognizable offence, the matter would have to be investigated and therefore the prayer to quash the first information report cannot be accepted.
The petition is dismissed without prejudice to the right of the petitioner to apply for bail or anticipatory bail, as may be advised.
